This applies to all individuals who live in New York but were convicted in other states or federal or military courts, and they must register within ten days of moving to New York.

There are three levels of offenses, depending on the individual offender’s risk of committing another sex crime and physical harm to the community – Level 1 (low), Level 2 (moderate), and Level 3 (high).

Which level applies to the particular case is decided by the sentencing judge at sentencing if one is sentenced to probation, and it’s often a matter of contention between prosecution and defense. If the person is sentenced to jail, the level is determined when that person is released. In these cases, the Board of Examiners of Sex Offenders will review the case and provide the report to the court. The judge will set a hearing to determine the risk level that should apply before the release. Less information will be made public if the lower risk is assigned. The higher the risk, the more information is available to the public.
